I wondered if you could provide me with all the relevant information in relation to the implications for owners of trees under a tree preservation order and how is this information disseminated to interested parties?

 

The implications for owners of trees protected under a Tree Preservation Order are contained with the Town and Country Planning (Tree Preservation)(England) Regulation 2012. In the process of making a Tree Preservation Order the Council writes to the owner of the tree the text of which is set out below:

 

In accordance with Regulation 5 of the Town and Country Planning (Tree Preservation) (England) Regulations 2012, I enclose the following documents in connection with this Tree Preservation Order, which has been made by my Council under the provisions of Section 198 of the Act of 1990:

 

(1) A copy of the Tree Preservation Order.

(2) A copy of the Notice of the making of the Order (including a copy of Regulation 6).

It should be noted that the Order took effect provisionally from (insert date) and will remain effective for a period of six months from that date or until confirmed by the Council.

Could you also advise what information is required from an owner for an application to work on a protected tree and what is required before work can commence. It would be helpful for me to obtain a suitable witness statement relating to the documentation needed under such circumstances.
